Texas Child Support Laws

Payment - Child support in Texas is based on a sliding scale, with the number of children being what determines what percentage will be used. The scale goes from 20% for 1 child up to 40+% for 6 or more children. These percentages are used on the first $6,000 in monthly income that the person who is paying child support makes. For income over $6,000, the judge may award what they see fit to continue to look after the well-being of the children.

Guidelines that could change payments - In some special circumstances, the strict percentage-based rules may not apply. The following issues are taken into consideration when looking at there should be a modification to the amount of child support owed: special needs of the child, custody of the child, resources for the child, alimony, college attendance, debt, and insurance.

Stopping child support payments - Child support payments may stop when any of these criteria are met:

1. Once the child is 18 or after they finish high school, whichever of these dates are later

2. The child gets married.

3. Either the child or the person paying child support dies.

In addition to this, if the child is disabled, child support payments may go on indefinitely.
