Contested - If an agreement dealing with the splitting of property and child custody cannot
be brokered between the two parties, then the divorce is a contested divorce. In Texas, a contested divorce requires
both sides, or their lawyers, to come to an agreement before a divorce is finalized. If this can't happen, there will be a trial.
Most of the time, the lawyers draft an agreement that both parties can agree on. If it goes to trial, the judge ultimately
has the final say.
Uncontested - This is the exact opposite of a contested divorce in Texas. If your divorce is uncontested, it means
both parties have come to an agreement without the need for litigation. Usually, a lawyer will write up an official agreement
and after reviewing it and finding it fair, both parties sign it, and that becomes the divorce agreement.
